In Spain there is no specific law regulating the production or consumption of CBD , so the substance is subject to the interpretation of international conventions and jurisprudence. In Spain, the first reference is the Single Convention on Narcotic Drugs of 1961 , where CBD is not specifically controlled , unlike THC, but cannabis extracts, tinctures or resins are.

The World Health Organization has reconsidered marijuana's inclusion on its list of drugs. The WHO indicates that CBD with 2% or less THC should not be subject to controls .

In December 2020, the European Court of Justice issued a ruling that established a very favorable precedent for the marketing of CBD products , stating that “a Member State may not prohibit the marketing of cannabidiol (CBD) legally produced in another Member State if it is extracted from the entire Cannabis sativa plant and not just from its fibers and seeds.”

Can CBD be sold online? If the product is marketed in a European Union country, as long as the THC content is less than 0.2% , the product can be sold in Spain . This is covered by the provisions regarding the free movement of goods within the Union, since CBD cannot be considered a narcotic.
